Does homeowners insurance cover roof code upgrades? (Ordinance or Law)
By Tom Kovack Jr., CEO · July 2, 2026 · Homeowner guide
Across 556 documented roof claims, DumbRoof-built packages won 197 and recovered $7.25M.
Short answer
Only if you have Ordinance or Law coverage (a separate Additional Coverage or endorsement — often worth about 10% of your dwelling limit). Standard policies pay to restore the roof to its prior condition, not to meet current code. Ordinance or Law coverage pays the extra cost of code-required upgrades — ice-and-water shield, drip edge, decking, ventilation — triggered when you replace a damaged roof.
How Ordinance or Law coverage works
When you replace a storm-damaged roof, current building code may require components your old roof did not have. Without Ordinance or Law coverage, the carrier can argue it only owes “like for like.” With it, they owe the code-driven upgrades too.
Ordinance or Law coverage (commonly 10–25% of dwelling coverage) reimburses the increased cost to comply with the code in force at the time of the loss.
Cite the exact code so items read as mandatory
The key is citing the exact code line so the item reads as mandatory, not optional — “we'd like new drip edge” loses; “R905.2.8.5 requires drip edge at eaves and rakes” gets paid. DumbRoof maintains the jurisdiction-specific code registry and cites the exact section on your scope so code-required items are documented as obligations.

People also ask
What is Ordinance or Law coverage?
A policy provision or endorsement (an Additional Coverage, not standard) that pays the increased cost of bringing a damaged structure up to current building code when you rebuild — beyond the like-for-like restoration a standard policy owes.
Does building code require ice and water shield?
In New York, RCNYS R905.1.2 designates the entire state an ice-barrier zone and requires the membrane from the eave edge to 24 inches inside the exterior wall line. Other states cite their adopted IRC edition.
Will insurance pay for new roof decking?
If deteriorated or water-damaged decking is exposed at tear-off, code (RCNYS R908.2) requires replacement regardless of cause — which is why it is a supplement item, though payment for the upgrade portion depends on Ordinance or Law coverage.
